1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Skyvia Travel ("Skyvia", "we", "our", or "us"), governing your access to and use of the Skyvia website (skyviatravel.com) and all related travel booking services. By accessing our website, creating an account, or making a booking, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services. If you are booking on behalf of other travelers, you agree to these Terms on their behalf and accept responsibility for their compliance.

2. Services Description

Skyvia provides travel facilitation services including: • Domestic and international flight bookings through airline suppliers and GDS platforms. • Accommodation stays at curated hotels, resorts, and villas with whom we hold direct supplier contracts. • Tour packages, adventure experiences, and custom itinerary planning. • Ground transportation coordination. • Travel advisory and concierge services. Skyvia acts as an intermediary agent between customers and travel suppliers. We do not own, operate, or control any airline, hotel, or transportation service. Final availability, pricing, and service quality are subject to individual supplier terms and conditions. A booking is confirmed only when we have verified availability and received full payment.

3. Account Registration

To make bookings, you may be required to create an account. You agree to: • Provide accurate, complete, and current information during registration. • Maintain the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. • Notify us immediately at bookings@skyviatravel.com if you suspect unauthorized access to your account. • Ensure that all travelers named in a booking are aware of and agree to these Terms. Skyvia reserves the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used for fraudulent purposes.

4. Booking Process and Confirmation

A booking request does not constitute a confirmed reservation. The booking process works as follows: 1. You submit a booking inquiry or request through our website or by contacting our team. 2. Our team verifies availability with the relevant supplier and prepares a payment link. 3. A booking is confirmed only after full payment is received and we have issued a written booking confirmation to your registered email address. 4. Payment must be completed within 24 hours of receiving the payment link, unless otherwise agreed in writing. Failure to pay within this window may result in automatic cancellation and potential price changes. Prices are quoted in Philippine Pesos (PHP) unless otherwise stated. All quoted prices are all-in and may not include government taxes, airport fees, visa fees, or other charges levied by third parties, which will be disclosed at the time of booking.

5. Payment Terms

All payments are processed through PayMongo, our authorized payment gateway. We accept GCash, Maya, major credit and debit cards, and QR Ph bank transfers, subject to availability at time of booking. • Full payment is required before a booking is confirmed, unless a deposit arrangement has been agreed in writing. • Skyvia does not store your full card details. Payment security is managed by PayMongo under PCI-DSS standards. • In the event that a payment is declined or reversed by your financial institution after a booking has been confirmed, Skyvia reserves the right to cancel the booking and may pursue recovery of any costs incurred. • Skyvia's booking processing charge is non-refundable unless the cancellation is due to our error or supplier failure beyond your control.

6. Cancellations, Changes, and Refunds

Cancellation and refund policies vary depending on the product booked and the supplier's terms: • Flights: Governed by the airline's fare rules. Non-refundable fares may result in no refund. Partially refundable fares are subject to airline-imposed penalties. • Hotels and Stays: Cancellation fees and free cancellation windows depend on the specific property and rate type booked, as disclosed at time of booking. • Packages and Tours: Cancellations made more than 30 days prior to departure may receive a partial refund minus non-recoverable supplier costs. Cancellations within 30 days of departure are generally non-refundable. For all refunds, any non-recoverable booking processing costs are non-refundable. Refunds from suppliers are processed in the timeline required by the supplier, typically 5–30 business days, and will be returned to the original payment method. Force majeure events (natural disasters, government travel bans, pandemics) are handled on a case-by-case basis at Skyvia's discretion.

7. Customer Responsibilities

You are solely responsible for ensuring that: • All travelers hold valid passports, visas, travel authority documents, and any other permits required by the destination country and transit points. • All health requirements for the destination are met, including vaccination certificates or health declarations where required. • All passenger names, dates of birth, and identification details submitted to Skyvia exactly match the official government-issued IDs of the travelers. • Travelers arrive at airports, ports, or pickup points with sufficient time before departure. Skyvia is not liable for any costs, losses, or damages arising from denied boarding, denied entry, missed connections, or refused travel due to insufficient documentation, incorrect passenger details, or failure to comply with destination health or entry requirements.

8. Limitation of Liability

To the fullest extent permitted by Philippine law: • Skyvia acts solely as an agent and is not liable for the acts, omissions, negligence, or failure of any airline, hotel, tour operator, or other travel supplier. • Skyvia is not responsible for delays, cancellations, overbooking, accidents, injuries, losses, or damage caused by force majeure events including but not limited to natural disasters, pandemics, strikes, government actions, war, or civil unrest. • Our aggregate liability to you for any claim arising from a booking shall not exceed the total amount paid by you to Skyvia for that specific booking. • We do not exclude or limit liability for fraud, death, or personal injury caused by our own negligence.

9. Travel Insurance

Skyvia strongly recommends that all travelers obtain comprehensive travel insurance covering medical emergencies, trip cancellations, lost baggage, and travel delays. While we may recommend insurance partners, the decision to purchase travel insurance and the adequacy of coverage selected are entirely the responsibility of the traveler. Skyvia is not an insurance provider and does not accept liability for uninsured losses.

10. Intellectual Property

All content on the Skyvia website — including but not limited to text, images, photographs, graphics, logos, icons, audio clips, video clips, data compilations, and software — is the property of Skyvia Travel or its content suppliers and is protected by Philippine and international copyright, trademark, and other intellectual property laws. You may access and use our content solely for personal, non-commercial purposes. You must not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, transmit, or sell any content from our website without our prior written consent.

11. User Conduct

When using our website and services, you agree not to: • Engage in fraudulent activity, including providing false identity information or making bookings with no intention to pay. • Use our services or website for any unlawful purpose or in violation of any applicable law. • Attempt to access, interfere with, or disrupt our systems, servers, or networks. • Scrape, crawl, or harvest data from our website using automated tools without prior written consent. • Use our website to transmit spam, unsolicited communications, malware, or other harmful content.

12. Privacy

Your use of our services is governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information in compliance with the Philippine Data Privacy Act of 2012 (RA 10173). By using our services, you acknowledge that you have read and understood our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or our services shall first be subject to good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be submitted to the jurisdiction of the appropriate courts of the Philippines. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court.

14. Amendments

Skyvia reserves the right to modify these Terms at any time. When we make material changes, we will post the updated Terms on this page with a revised effective date and, where appropriate, notify registered users via email. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with any change, you must stop using our services and may request deletion of your account by contacting bookings@skyviatravel.com.

15. Severability and Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, Cancellation Policy, and any booking-specific terms communicated at the time of booking, constitute the entire agreement between you and Skyvia and supersede all prior agreements, representations, or understandings.
